Terms of Service

Last updated: 31 October 2026

These terms govern your use of DarkScan, including the website at darkscan.rakshiq.com, the DarkScan Shopify app, and any scan, report or audit (together, the "Service"). The Service is operated by Repwave ("we", "us"). By using the Service you agree to these terms. If you use it for a business, you confirm that you may bind that business.

1. What DarkScan is

DarkScan is an automated tool that visits an online store like a customer and looks for signs of the dark patterns listed in Annexure 1 of the Guidelines for Prevention and Regulation of Dark Patterns, 2023. It gives you evidence to use in your own self-audit.

2. What DarkScan is not

Automated self-audit aid. Not legal advice or certification.

3. Results can be wrong

Results are produced by automated rules and an AI language model. They can include false alarms and can miss real problems. "Passed" means only that this scan saw no sign of the pattern on the pages it reached at that time; it does not mean the store is free of the pattern. Stores change, and some pages, checkouts, apps and devices may not be reached. "Likely cause" and fix suggestions are best guesses. Check every result yourself before acting on it, and test changes on a copy of your theme.

4. Your responsibilities

5. How the scanner behaves

The scanner does not enter payment details, place orders or complete cancellations, and it stops if it meets a CAPTCHA or bot check. It may add a product to a cart and open the first checkout page, which can appear in your analytics as an abandoned cart. The Shopify app only reads your theme files and does not change them.

6. Fees

7. Your content and ours

You keep all rights in your store and its content. You allow us to access your store's pages and theme files, and to store screenshots and page copies, only to provide the Service. We keep all rights in the Service. You may use your reports for your own business, including sharing them with your advisers.

8. Availability

The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all implied warranties, including accuracy, fitness for a particular purpose and uninterrupted operation. We may change or stop any part of the Service.

9. Limit of liability

To the extent the law allows:

Nothing in these terms excludes liability that cannot be excluded by law, including for fraud.

10. Indemnity

You will compensate us for losses and reasonable costs arising from a claim caused by your breach of these terms, including scanning a store without authorisation or misrepresenting a report as a certificate.

11. Ending use

You may stop using the Service at any time. We may suspend or end access if you breach these terms or if needed to protect the Service or others. Sections 2, 3, 9, 10 and 13 continue after use ends.

12. Changes

We may update these terms, and we will post the new version here with a new date. Continuing to use the Service after that means you accept the update.

13. Law and disputes

These terms are governed by the laws of India. Please contact us first so we can try to resolve any dispute. Otherwise, disputes are subject to the jurisdiction of the competent courts in India. If any part of these terms is unenforceable, the rest continues to apply.
